Welcome to By Your Side. By booking or using our services, you agree to the following Terms & Conditions. Please read them carefully before making a booking.​

1. About Us

By Your Side provides photography services and wedding day dog chaperone services throughout New Zealand.

These Terms & Conditions apply to all enquiries, bookings, services, and interactions with By Your Side.​

2. Bookings & Deposits

A booking is not confirmed until:

• The required booking form or agreement has been completed

• Any requested deposit has been paid

• Written confirmation has been provided by By Your Side

Dates cannot be held without confirmation and any required payment.

3. Payments

Invoices must be paid by the due date stated on the invoice.

Where a deposit is required:

• Deposits are non-refundable unless otherwise agreed in writing.

• The remaining balance must be paid by the date specified on your invoice or service agreement.

Failure to make payment may result in cancellation of services.

4. Cancellations & Rescheduling

Photography Services

If you need to cancel or reschedule your photography session, please provide as much notice as possible.

Deposits may be transferred to an alternative date at the discretion of By Your Side, subject to availability.

Dog Chaperone Services

Wedding dates are often booked well in advance. Cancellations may result in the loss of your deposit.

Any rescheduled date is subject to availability and cannot be guaranteed.

5. Weather & Unforeseen Circumstances

Photography sessions may be rescheduled due to adverse weather conditions where outdoor photography would be unsuitable.

By Your Side reserves the right to reschedule services in the event of illness, injury, emergency, unsafe conditions, venue restrictions, or circumstances beyond reasonable control.

Where possible, reasonable efforts will be made to arrange an alternative date.

Photography Services

6. Photography Style

Clients acknowledge that they have reviewed By Your Side's portfolio and understand the artistic style, editing approach, and creative interpretation of the photographer.

Final images are delivered at the photographer's professional discretion.

RAW or unedited files will not be provided unless otherwise agreed in writing.

7. Image Delivery

Image delivery timeframes may vary depending on workload and season.

Images will be delivered digitally unless otherwise agreed.

By Your Side will make reasonable efforts to preserve image files; however, clients are responsible for creating and maintaining their own backups once images have been delivered.

8. Client Cooperation

Clients are responsible for:

• Arriving on time

• Ensuring all participants are present and prepared

• Obtaining any necessary permissions for locations

• Supervising children during sessions

By Your Side is not responsible for missed photographs resulting from lateness, lack of cooperation, weather changes, or circumstances outside our control.

9. Copyright & Image Use

All photographs remain the copyright of By Your Side unless otherwise agreed in writing.

By purchasing photography services, clients receive a personal-use licence to:

• Share images online

• Print images for personal use

• Store images for personal use

Images may not be:

• Sold for commercial purposes

• Edited with filters or altered significantly

• Submitted to competitions without permission

10. Marketing & Portfolio Use

By Your Side may use photographs for:

• Website galleries

• Social media

• Marketing materials

• Portfolio displays

If you prefer your images not be used, please notify us in writing before your session.

Wedding Day Dog Chaperone Services

11. Dog Health & Behaviour

Clients confirm that their dog:

• Is in good health

• Is free from contagious illnesses

• Has no known aggressive tendencies unless disclosed before booking

• Is appropriately vaccinated and legally registered where required

Any behavioural concerns must be disclosed before the wedding day.

12. Client Responsibilities

The client agrees to provide:

• Accurate information about their dog

• Emergency contact details

• Veterinary contact information

• Feeding instructions

• Any required medications

• Leads, harnesses, crates, and other necessary equipment

By Your Side may decline services if information provided is found to be inaccurate or incomplete.

13. Safety & Welfare

The welfare of your dog is our highest priority.

By Your Side reserves the right to:

• Remove a dog from a stressful situation

• Decline requested activities deemed unsafe

• Refuse transport if conditions are unsuitable

• Modify plans where necessary for the dog's wellbeing

All decisions regarding safety and welfare will be made in the best interests of the dog.

14. Veterinary Emergencies

In the event of a medical emergency involving your dog:

• Reasonable efforts will be made to contact the owner or nominated emergency contact

• By Your Side may seek veterinary treatment if immediate care is required

Any veterinary costs incurred remain the responsibility of the owner.

15. Transportation

Where transportation of a dog forms part of the service:

• Dogs must be safely restrained where required by law

• Owners must disclose any medical or behavioural conditions that could affect transport

• By Your Side is not responsible for delays caused by traffic, road closures, weather conditions, or events beyond reasonable control

16. Liability

While every reasonable effort is made to provide safe and professional services, By Your Side cannot guarantee against:

• Injury

• Illness

• Escape

• Loss

• Property damage

• Unexpected animal behaviour

To the maximum extent permitted by law, clients acknowledge the inherent risks associated with working with animals and agree that By Your Side shall not be liable for circumstances beyond reasonable control.

Nothing in these Terms excludes any rights available under New Zealand consumer law.

17. Venue Requirements

Clients are responsible for ensuring:

• Dogs are permitted at the ceremony and reception venues

• Required permissions have been obtained

• Venue rules are followed

By Your Side is not responsible for changes in venue policies or restrictions imposed by third parties.

All content found on this website, including photographs, text, branding, graphics and logos, remains the property of By Your Side and may not be copied, reproduced or distributed without permission.

19. Third-Party Links

Our website may contain links to external websites. By Your Side is not responsible for the content, policies, or practices of any third-party websites.

20. Limitation of Liability

By Your Side will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website or services, except where required by law.

By Your Side reserves the right to update these Terms & Conditions at any time.
